Second Judge Rejects DOJ Request To Swap Lawyers

Maryland — A Maryland federal judge has denied a motion for the Department of Justice to swap out lawyers working on the citizenship question case regarding the 2020 Census.

In the ruling explanation, Judge George Hazel states, “The Court wholeheartedly agrees that it is the Attorney General who has the authority to determine which officers the Department of Justice shall “attend to the interests of the United States.” But Defendants must realize that a change in counsel does not create a clean slate for a party to proceed as if prior representations made to the Court were not in fact made.”

Further, Hazel states, “…While the Court is inclined to ultimately permit the withdrawal, under the unique circumstances of this request, more specific assurances will first need to be provided.”
